Divorce by mutual consent

Getting a divorce in Thailand can be a tricky process. Many people do not have a clear idea about what is required, or how it will affect them. However, if you have the right knowledge, a Thai divorce can be an easy process.

The process of getting a divorce in Thailand is governed by the Thai Civil and Commercial Code. There are two main types of divorce. The first type is a mutually consented divorce. This type is less expensive and easier to get.

To file for a mutually consented divorce in Thailand, both spouses must agree to end the marriage and divide the assets. In addition, both spouses must agree on custody of the children. There must also be agreement on alimony and child support.

Child custody

Whether you are married or unmarried, child custody is an issue that can arise at any stage. The standard in child custody law in Thailand is to give equal rights to both parents.

There are a number of factors that the court will consider when deciding the best care for your child. One of the most important factors is the best interest of the child. This is usually determined through a social worker’s report. It can take up to six months for a dispute to be resolved. Click here to find a lawyer in Thailand.

The first step is to file a Petition to Court. You will need strong evidence that you are depriving the other parent of his/her rights. The court will then decide whether you are qualified for custody.

In Thailand, the Observation and Protection Center (OPC) is an appointed social worker who will do a preliminary study of your case. The report is then sent to the Family Court to be evaluated.
